A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without legal authority.
"Since his return from wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The case stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to answer human smuggling charges, he was detained in immigration detention.
In her decision, the court noted that the authorities lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
